Your enrollment in this course constitutes acceptance of the terms and conditions as of the date on which you first enroll as a student.

Texas Process Servers Academy reserves the right to change these terms and conditions at any time by posting such changes online. Your continued use of this site is an acknowledgment that you have read and agree with the current terms and conditions, including those changes posted after you first enrolled, and constitutes your acceptance of this agreement as modified.

You agree to use this site only for lawful purposes, and in a manner which does not infringe on the rights, or restrict or inhibit the use and enjoyment of the site by any other third party.  You agree to not copy, paste, print, photograph, or in any way duplicate any portion of this website or its contents, and understand that if you do so you will violate federal copyright protections and will be knowingly stealing legally protected proprietary information, subjecting you to civil liability and criminal prosecution.

This Course accurately includes, in whole or in part, the current laws, rules and regulations that govern or control the service of legal process in Texas. All narrative and textual content was written under the editorial oversight of licensed attorneys to ensure legal accuracy and integrity.

  • Once you enroll and pay tuition, you have 90-days within which to start and complete the course.
  • Once you begin the course, there are NO REFUNDS.
  • If you do NOT complete the course within 90-days, your access will be denied, and you will forfeit any tuition you paid.

 

Special consideration, however, will be given in the case of emergency situations that make completion of the course impossible, but that decision is left entirely to the discretion of the Administrator.  Each case is considered on an individual basis, and a decision by the Administrator to give a refund to one person does not mean a refund will be given to any other person.

This site and the information it provides, including names, text, images, pictures, videos, logos, software, code, content and design, are copyright protected, and are provided “as is”, without any representation or endorsement and without any warranty of any kind, whether express or implied. In no event will Texas Process Servers Academy, its owners, agents or assigns, be liable for any damages to any party, including, without limitation, indirect or consequential damages, or any damages whatsoever arising from the use or in connection with such use or loss of use of the site, whether in contract or in negligence.

The Texas Process Servers Academy cannot and does not warrant that the software functions that have been written to present this course online, or that may be contained in the material included in this course, will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or bugs that may damage your computer, nor do we represent the full functionality, accuracy and reliability of the materials. We only promise that every attempt has been made to provide you with a website that is as free from defect as possible and will work as well as we can make it, given the limitations under which we are required to operate.

The fact that the Texas Process Servers Academy issues you a Certificate of Proficiency is in mutual consideration of your having paid all tuitions and fees due the Texas Process Servers Academy for the course of instruction we offer, and that your failure to pay such fees before or subsequent to the issuance of such Certificate, including the subsequent invalidation of any prior payment by you, by PayPal or by any other banking authority that accepts payment on behalf of Texas Process Servers Academy, negates and invalidates such Certificate until such fees and tuitions are paid in full. Subsequent re-issuance of such Certificate of Proficiency by Texas Process Servers Academy upon payment of such fees and tuitions is at the sole discretion of Texas Process Servers Academy, and student waives any and all recourse against Texas Process Servers Academy, Cat's-Eye Intelligence Service, its owners, principals, managers and agents for withholding such certificate even after payment of such fees and tuitions.

Please be advised under the Private Security Act (Occ. Code Chapter 1702) and Administrative Rule 35.4 (37 Tex. Admin. Code 1), a criminal conviction may disqualify you from a registration, commission or license under the Act. You may wish to review the list of disqualifying offenses and the related periods of ineligibility found under Rule 34.4, available on the department’s website at http://www.dps.texas.gov/rsd/psb/index.htm (click on the link to Administrative Code).  You also have a right to request from the department a criminal history evaluation letter under Occupations Code Section 53.102.
